Supreme Court decision and EHRC interim guidance – quick recap
In April 2025, the Supreme Court ruled that ‘sex’ in the context of the Equality Act meant the sex assigned to the individual birth. The ruling narrows legal concepts of gender and impacts trans people’s access to single-sex services and spaces, such as bathrooms, hospitals, sports facilities and charities.
The Equality and Human Rights Commission (EHRC), which is a UK public body charged with monitoring human rights and protecting equality, then started to re-draft its code of practice to reflect the Supreme Court ruling. It published interim guidance which advised employers and service providers to exclude trans people from accessing gendered spaces and services and toilets. Many employers then acted on that interim advice, causing untold harm and suffering to the trans community.
The EHRC has now quietly withdrawn its interim guidance and advised employers and service providers that they must seek specialist legal advice to understand how to implement the Supreme Court ruling.
The Good Law Project applied for judicial review against the EHRC to challenge the interim guidance. Even though this has now been withdrawn, the guidance has had a hugely negative impact, and the EHRC must be held to account for having issued it in the first place. If the High Court finds the guidance to have been unlawful, then this provides substantial legal grounds for challenging employers and service providers which enacted policies based on the guidance. It is also hoped that an unlawful finding by the High Court will require stronger safeguards around trans rights in the EHRC’s new code of practice.
The trial is going ahead on 12 November 2025.
